Terms of Service

1. Acceptance of Terms

By accessing or using PageSwipe ("the Service"), including our website, iOS application, and any related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and PageSwipe ("we," "us," or "our"). We may update these Terms from time to time, and your continued use of the Service after any changes constitutes acceptance of the updated Terms.

You must be at least 13 years of age to use the Service. By using PageSwipe, you represent that you are at least 13 years old. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

2. Description of Service

PageSwipe is a book discovery and reading companion platform that provides:

• Book Discovery: An intuitive swipe-based interface to discover new books tailored to your preferences
• Reading Lists Management: Tools to organize books into lists such as "Want to Read," "Currently Reading," and "Finished"
• Book Clubs: Private groups where you can read together with friends, family, or colleagues
• Personal Library Cataloging: The ability to track books you own, including barcode scanning functionality
• Personalized Recommendations: Book suggestions based on your preferences and reading history

The Service is available on iOS devices and through web browsers. Features may vary between platforms.

3. User Accounts

Registration

To access most features of PageSwipe, you must create an account. You can register using:

• Email address and password
• Sign in with Apple
• Sign in with Google

Account Information

You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and secure
• Notify us immediately of any unauthorized use of your account

Account Security

You are responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

One Account Per Person

Each person may only maintain one account. Creating multiple accounts may result in termination of all accounts.

4. Subscription Terms

Free Tier

PageSwipe offers a free tier that includes:

• Two default reading lists (Want to Read, Finished)
• Ability to join book clubs created by others
• Up to 50 books in your My Books library
• Book discovery and swiping
• Barcode scanning

PageSwipe Pro (Premium Subscription)

PageSwipe Pro is a paid subscription that unlocks additional features:

• Unlimited custom reading lists
• Create unlimited book clubs
• Unlimited book library
• Priority support
• Early access to new features
• Ad-free experience

Pricing and Billing

PageSwipe Pro is available at the following rates:

• Monthly: $3.99 per month
• Annual: $39.99 per year (equivalent to $3.33/month)

Prices are in US dollars and may vary by region. Applicable taxes may be added at checkout.

Payment Processing

• iOS: Payments are processed through Apple's App Store. All billing is handled by Apple according to their terms.
• Web: Payments are processed through Stripe via RevenueCat. We accept major credit and debit cards.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. You will be charged within 24 hours before the end of your current period.

Cancellation

You may cancel your subscription at any time:

• iOS: Manage subscriptions through your Apple ID settings
• Web: Manage subscriptions in your PageSwipe account settings or contact support

Upon cancellation, you will retain access to Pro features until the end of your current billing period. After that, your account will revert to the free tier.

Refunds

• iOS Purchases: Refunds are handled by Apple. To request a refund, visit reportaproblem.apple.com or contact Apple Support.
• Web Purchases: We offer refunds within 7 days of purchase if you are unsatisfied with the service. Contact support@pageswipe.tech to request a refund.

Free Trial

We may offer a 7-day free trial for new subscribers. If you do not cancel before the trial ends, you will be charged for the subscription. Free trials are limited to one per person.

5. User Content

Your Content

You retain ownership of all content you create or upload to PageSwipe, including:

• Your reading lists and library
• Book club names and descriptions
• Book suggestions and votes
• Profile information

License to PageSwipe

By using the Service, you grant PageSwipe a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of operating and providing the Service. This includes:

• Displaying your content to other members of book clubs you join
• Showing your profile information to club members
• If you enable public lists, displaying that content publicly

Content Restrictions

You agree not to post content that:

• Is illegal, harmful, threatening, abusive, harassing, or defamatory
• Infringes on intellectual property rights
• Contains personal information about others without consent
• Is spam or commercial solicitation
• Contains malware or malicious code

We reserve the right to remove any content that violates these Terms without notice.

6. Intellectual Property

PageSwipe's Intellectual Property

The Service, including its design, features, code, graphics, and branding, is owned by PageSwipe and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the Service or any part of it
• Reverse engineer or attempt to extract source code
• Use our trademarks or branding without permission
• Create derivative works based on the Service

Third-Party Book Data

Book metadata, descriptions, and cover images displayed in PageSwipe are sourced from third-party providers including:

• Google Books API
• Open Library API

This content is provided by these services and is subject to their respective terms and intellectual property rights. PageSwipe does not claim ownership of this book data.

Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use this feedback without compensation or attribution to you.

7. Prohibited Conduct

When using PageSwipe, you agree not to:

• Violate any applicable laws or regulations
• Impersonate another person or entity
• Share your account credentials with others
• Use automated systems (bots) to access the Service
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Scrape or collect data from the Service without permission
• Use the Service for any commercial purpose without authorization
• Harass, abuse, or harm other users
• Circumvent any access or usage restrictions

8. Termination

Termination by You

You may delete your account at any time through the app settings. Upon deletion:

• Your personal data will be permanently deleted within 30 days
• Your membership in all book clubs will be removed
• Any active subscription will continue until the end of the billing period but will not renew

Termination by PageSwipe

We may suspend or terminate your account at any time if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your conduct harms other users or the Service
• We are required to do so by law

We will provide notice of termination when reasonably possible, except in cases of severe violations.

Effect of Termination

Upon termination, your right to use the Service immediately ceases. Sections of these Terms that by their nature should survive termination will remain in effect.

9. Disclaimers

To the fullest extent permitted by law, PageSwipe disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or completeness of any book data or information
• Warranties that defects will be corrected

Book Availability

PageSwipe is a discovery and tracking tool. We do not sell books, and we make no guarantees about:

• The availability of any book for purchase or borrowing
• The accuracy of book information, descriptions, or cover images
• The quality or content of books discovered through the Service

Third-Party Services

We are not responsible for the practices, content, or availability of third-party services we integrate with, including Google Books, Open Library, Firebase, or payment processors.

10. Limitation of Liability

To the maximum extent permitted by law:

• PageSwipe shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• PageSwipe shall not be liable for any loss of profits, data, use, goodwill, or other intangible losses
• Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater

These limitations apply regardless of the theory of liability and even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, our liability will be limited to the greatest extent permitted by law.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts.

Dispute Resolution

Before filing a claim, you agree to attempt to resolve any dispute informally by contacting us at support@pageswipe.tech. We will attempt to resolve the dispute within 30 days.

12. Changes to Terms

We may modify these Terms at any time. When we make material changes:

• We will update the "Last Updated" date at the top of this page
• We will notify you via email or in-app notification
• For significant changes, we may provide 30 days notice before they take effect

Your continued use of the Service after changes take effect constitutes acceptance of the new Terms. If you do not agree to the changes, you must stop using the Service and may delete your account.

Additional Terms for Apple App Store

If you downloaded PageSwipe from the Apple App Store, the following additional terms apply:

• These Terms are between you and PageSwipe only, not with Apple
• Apple has no obligation to provide maintenance or support for the app
• Apple is not responsible for any product warranties or claims
• Apple is a third-party beneficiary of these Terms
